A 10-year-old boy who strangled his three-year-old nephew because the younger boy was crying too much has been sentenced for culpable homicide.
The Jigawa state high court sitting in Gumel tried the boy, and Justice A.M. Sambo said the offence is contrary to Section 221(b) of the Penal Code Law of Jigawa State.
The prosecution established the fact that the defendant took his three-year-old nephew (name withheld) from his grandmother’s house to his mother’s home.
On their way, the defendant kept his nephew under a tree to fetch some grasses in a nearby bush, but the deceased started crying which upset the defendant. Then he strangled the crying boy.
The defendant subsequently dug a shallow grave and buried the boy.
After much interrogation at home, the defendant led the father of the boy he killed, their war head and police men to where he buried him.
The corpse was exhumed and taken to a General Hospital in Gumel for medical examination.
The judge on Thursday convicted the defendant and ordered him kept at Kafin Hausa reformatory centre at the governor’s pleasure.

This is a premature judge if truly the boy is 10yrs old,the very person that need to be sentence is the parent of these children for not providing and giving them attention,if the parent had given them attention,this can not happened. The case should be reverse and set free the innocent boy who lack family attention.
