The National Industrial Court Abuja on Tuesday dismissed a fresh suit by Umar Lawal, President of the National Association of Nigerian Students (NANs), seeking the court to compel the Academic Staff Union of Universities (ASUU) to call off its seven months strike and reopen the universities.

Justice Polycarp Hamman on Tuesday dismissed the suit as counsel to Lawal, Debo Ikuesan, withdrew the suit, saying that the student body is challenging his client’s position as president, denouncing him as NANS president.

Counsel to ASUU, Marshal Abubakar, also told the court that he is not opposing the application to withdraw the suit.

The plaintiff was seeking an order of the court to among others, order ASUU to call off its strike, as well as an order of the court restraining ASUU and its members from further engaging or partaking in the industrial action they commenced.

The outgoing NANs President, Sunday Asefon, had approached the court claiming that Umar Lawal does not have the mandate of NANS to commence the action.

He said Umar Lawal had contested and lost the position of National President of NANS.

The counsel, therefore, sought an order of the court to discontinue the suit following the objection from NANs.
