The National Agency for Food and Drug Administration and Control (NAFDAC) has clarified that it has not been formally served with any court injunction halting the enforcement of its ban on sachet alcohol.

The Director-General of NAFDAC made this disclosure amid reports of legal challenges to the agency’s prohibition of small-volume alcoholic beverages packaged in sachets and small bottles.

The statement suggests that NAFDAC intends to continue enforcing the controversial ban despite ongoing litigation and resistance from stakeholders in the alcoholic beverage industry.

NAFDAC’s ban on sachet alcohol, which targets small, affordable alcoholic products popular among low-income consumers, has been justified on public health grounds. The agency has cited concerns about alcohol abuse, underage drinking, and health risks associated with these products.

However, the prohibition has faced significant pushback from manufacturers, distributors, and retailers who argue that it threatens jobs and livelihoods within the industry.

By emphasizing that no formal court order has been served, the NAFDAC Director-General appears to be asserting the agency’s authority to proceed with implementation until legally compelled to do otherwise.

Legal experts note that even if injunctions have been granted, they only become enforceable once parties are formally served with the court documents.

The controversy highlights the ongoing tension between public health regulations and economic interests in Nigeria’s beverage sector.
