Roughly a month ago, an x-rated video of an alleged 10 year old pupil of Chrisland School made rounds on Social media platforms especially Twitter. As it seems, while condemning the act, some persons failed to understand that it would be an offence to share the x-rated video online.
This is no doubt, a brief summary of the case brought against a 40-year-old broadcaster, Uche Igwe by the Prosecution counsel attached to the State Criminal Investigation Department on May 9, before a Yaba Chief Magistrate’s Court in Lagos State.
Factually, the Defendant, Mr Uche Igwe was arraigned on a two-count charge of cyberstalking and breach of peace, which according to the prosecutor, contravened Section 24 (1)(a)(b)(i) of the Cybercrime (Prohibition and Prevention) Act of 2015, and Section 168 (d) of the Criminal Law of Lagos State, 2015.
According to the Prosecutor, the accused Uche Igwe committed the offence on April 18, when he intentionally posted the video of the 10 year old female pupil with another student in Dubai. He also disclosed the punishments associated with each crime, as stipulated by the Act and law.
In other words, the prosecutor told the court that the Cybercrime act stipulates 10 years imprisonment for cyberstalking while the Breach of peace is punishable with three months’ jail term under the Criminal Law of Lagos State.
Meanwhile, the case was adjourned by the Chief Magistrate after Mr Uche pleaded not guilty.
