How judge made a sudden change that kept Soludo and supporters in suspense over moves against him

The presiding Judge, Justice Taiwo Taiwo of the Federal High Court Abuja has kept Prof. Charles Soludo and his supporters in suspense regarding his fate in the moves against his victory by rivals over the outcome of the Anambra State governorship election.

This is because the Judge failed to show up to hear the suit or deliver a judgment in the case as scheduled when parties came forward for that purpose. Initially, the case filed by Valentine Adindu and Egwudike Chukwuebuka, seeking to disqualify Soludo and nullify his victory for giving false information in his nomination form (E9) was scheduled to be heard and decided yesterday being November 30, 2021.

Why did the Judge fail to decide the case?

The main reason why the Judge failed to hear or decide the case was not immediately stated. According to a report, a notice on the court stated that the Judge would not sit to hear the case that yesterday as it was scheduled but it would be heard today instead. It went on to apologize o the lawyers/parties involved for any inconveniences that sudden change in the date might have caused them.

There may be some main reasons why the Judge made this sudden or unexpected change in date regarding when to hear and decide the case. First, it could be that the Judge has not concluded his own background work of going through the facts of the case. In that case, he would like to do the needful before hearing the it. So, he would need more time to help him conclude all that he would like to do in preparation before hearing nd deciding the case.

Again, it could be that there are some unforeseen circumstances that arose on the part of the Judge which could not make the him to sit over the case that yesterday. Well, while it would have been better for the Court to have written to the parties involved ahead of time or may be put a call across to them, that did not happen. The parties only got to the court to know about the sudden change in date to their chagrin. But, they could not do much than to accept the situation.

However, it must be noted that the Court has the prerogative to make some changes. The Judge only did a diplomatic thing by apologizing because he knew that the sudden change in date without prior notice or formal notification to the parties would have caused some forms of inconveniences to them. The difference is one day. The Judge promised that he would hear the case today and possibly decide it to determine Soludo’s fate. Will Soludo scale through or lose the case?
