Court strikes out Obanikoro’s suit against EFCC

The Federal High Court, Lagos has stricken out the fundamental rights enforcement suit filed against the Economic and Financial Crimes Commission, EFCC, by Musiliu Obanikoro.

The former Minister of State for Defence had, along with his wives, Fati and Moroophat, and his sons, Gbolahan and Babajide, dragged the commission to court over the invasion of their residence and seizure of some of their properties.

Their lawyer, Lawal Pedro, had asked the court to award N100 million to his clients for the violation of rights they suffered from the EFCC.

But Justice Abdulaziz Anka, struck out the plea saying it was incompetent. He noted that their houses were searched based on duly issued search warrants from the Lagos State Magistrates’ Court.

Justice Anka said he could not declare the recovered items as null and void, so as not to foreclose the possibility of the EFCC tendering them as exhibits in imminent criminal case against the Obanikoros.
