Sunset on Abba Kyari, court delivers judgement on extradition March 23
The suspended Deputy Commissioner of Police, DCP Abba Kyari, is facing extra-difficult battle for survival on two cases within and outside Nigeria.
The Attorney General of the Federation and Minister of Justice, Abubakar Malami, had approached the court on March 3 with an application marked: FHC/ABJ/CS/249/2022, seeking judicial pronouncement on the extradition of Kyari to the US for prosecution on alleged link to Hushpuppi. The trial court, Abuja Division of the Federal High Court on Wednesday scheduled the case for hearing on March 23.
The suit, titled: “Application for the Extradition of Abba Alhaji Kyari to the United States of America,” dated and filed on March 2, was filed under the Extradition Act, was assigned to Justice Inyang Ekwo by the Chief Judge of FHC, Justice John Tsoho. The action indicated that the Nigerian government has approved of the request of the U.S. for extradition of Kyari.
The federal government said that the Diplomatic Representative of the Embassy of the United States of America (USA), Abuja, had requested for the extradition of Kyari for a case in the US.
Abubakar Malami had revealed that the case was filed on in the U.S. District Court for the Central District of California, USA, on April 29, 2021. The Minister indicated that Kyari will be facing a three-count charge. He highlighted that charge as follows:
“Count one: Conspiracy to commit wire fraud in violation of Title 18, United States Code, Sections 1349, ll.
“Counts two: Conspiracy to commit money laundering in violation of Title 18, United States Code, Sections 1956(h)
“Count three: Aggravated identity theft and aiding and abetting, in violation of Title 18 U.S.C, Sections 1028A (a){1}j and 2(a).”
