NCC, FCCPC forge strategic alliance to boost consumer protection, competition in telecom sector

In a groundbreaking move aimed at enhancing consumer protection and fostering healthy competition in Nigeria’s telecommunications sector, the Nigerian Communications Commission (NCC) and the Federal Competition and Consumer Protection Commission (FCCPC) have formally executed a Memorandum of Understanding (MoU).

The landmark agreement, signed at a high-profile ceremony on January 14, 2025, underscores the commitment of both regulatory bodies to safeguard the interests of Nigerian consumers and ensure a fair and competitive market landscape.

In his remarks, Dr. Aminu Maida, the Executive Vice-Chairman of the NCC described the event as “long coming,” highlighting that it is the culmination of extensive discussions and collaborative efforts aimed at strengthening consumer rights within the telecommunications industry.

He emphasized the pivotal role of the telecom sector in Nigeria’s economic and social development, noting that it serves as a critical driver of the nation’s digital transformation.

“Today, we celebrate the beginning of a strategic partnership between two critical regulatory institutions,” Dr. Maida stated. “This MoU is a testament to our shared vision of fostering a transparent, competitive, and consumer-focused telecommunications industry.”

The agreement seeks to harmonize the mandates of both the NCC and FCCPC, ensuring a streamlined and effective regulatory framework. This alignment will minimize regulatory uncertainty, provide clarity for stakeholders, and advance the Federal Government’s Ease of Doing Business initiative.

Dr. Maida also highlighted the challenges facing the sector, such as market abuses, consumer rights violations, and the complexities arising from the rapidly evolving digital economy. He stressed the need for a unified approach to tackle these issues effectively.

“This partnership highlights the importance of synergy in regulatory oversight. The challenges we face demand a united front and consistent policy implementation. This MoU ensures that our respective mandates are harmonized to achieve maximum impact,” he added.

In his own opening remarks, Mr. Tunji Bello, the Executive Vice Chairman and Chief Executive Officer of the FCCPC, warmly welcomed his counterpart, Dr. Aminu Maida, and the NCC delegation to the historic event.

He highlighted the intricate nature of regulatory frameworks, explaining how overlapping regulations are designed to prevent critical issues from falling through the cracks.

“The interwoven relationship between the FCCPC and NCC ensures that if one agency, due to certain limitations, fails to address a consumer issue or regulatory violation, the other agency, with its unique perspective, can step in effectively,” Mr. Bello stated.

Mr. Bello emphasized the legal foundation for this collaboration, referencing Section 105 of the Federal Competition and Consumer Protection Act (FCCPA) of 2018. This section mandates cooperation between the FCCPC and sector-specific regulators, ensuring comprehensive oversight and eliminating regulatory conflicts or duplications.

He further noted that the MoU would simplify interactions for consumers, allowing them to avoid navigating between two agencies for the same issue. The collaboration also aligns with the Federal Government’s vision of fostering economic growth through regulatory efficiency and prioritizing consumer welfare.

Mr. Bello also commended the NCC leadership for their cooperation throughout the journey, which he described as both challenging and rewarding. He expressed confidence that this partnership would yield significant benefits for both operators and consumers, ensuring a harmonious regulatory environment.

“Guided by our shared vision, this partnership will foster seamless collaboration between our organisations, streamline operations, and promote fair competition while safeguarding consumer interests,” he added.

Mr. Bello urged other sector regulators to follow this example by establishing similar frameworks with the FCCPC, as mandated by law. He stressed the importance of comprehensive regulatory oversight across all sectors to ensure that Nigerian consumers benefit from a unified and coordinated regulatory approach.
