4 businessmen docked for alleged mischief, inciting public disturbance

Four businessmen on Thursday appeared in a Wuse Zone Six Magistrates’ Court, Abuja, for alleged mischief and inciting public disturbance in the Duste Alhaji Market.
The police charged Donatus Iheme, 46, Amadi Ikechukwu, 49, Sunday Markus 42, and Ibrahim Yakubu, 40, all businessmen of Duste Alhaji Market, Abuja with three counts of joint act, mischief and inciting public disturbance.
The defendants however, pleaded not guilty to all three charge.
The Prosecution Counsel, Charity Okoro, told the court that Mr Saidu Gambo of Duste Alhaji, Abuja, reported the matter at the Wuse Police station on July 2.
Okoro alleged that the four defendants and others, at large formed a common intention and mischievously broke the Duste Alhaji Market wall fence that was built by the FCT Administration.
She told the court that the defendant’s action ruined the original plan of the market design which was capable of provoking public disturbance to traders and members of public.
The counsel alleged that during police investigation all four defendants arrested by the police admitted to the crime, stating that their intention was to create additional entrance gate into the market.
Okoro said the offence contravened the provisions of sections 97, 327 and 114 of the Penal Code Law.
Magistrate Aminu Eri admitted the defendants to bail in the sum of N5 million each and two reasonable sureties each.
Eri, ordered that the sureties must reside within the court’s jurisdiction, with a means of livelihood and must present an identity card which must be verified by the court registrar.
The magistrate adjourned the case until Sept.2, for hearing.
