Court grants leave to file criminal charge, extradition order against Kyari
Justice Bolaji Belgore of the Federal Capital Territory has granted an order for leave to file an application for “order of mandamus” against the suspended commander of the IGP Intelligence Response Team Abba Kyari.
The order will ensure AGF ABubakar Malamai and the Nigeria police file criminal charges, including an extradition order, against Kyari.
The leave was granted on Thursday, November 4 following a suit filed by the President of One Love Foundation, Patrick Eholor following a US arrest warrant against the embattled senior police officer.
Eholor filed the suit with DCP Abba Kyari, AGF and the Nigeria Police Force as parties.
Eholor, through his lawyer, Paul Odeh Esq, while moving the application, urged the court to consider the entire annexures of indicting criminal complaints from the USA District Court and the failure of the 2nd and 3rd defendants, (AGF and Nigeria Police Force) to properly commence investigation and file charges against DCP Abba Kyari, even after an investigation into the graft charges brought upon him by the federal authorities of the US.
Justice Belgore listened to Elohor arguments, and granted the ‘Leave of Mandamus’ to file a suit for criminal charges, extradition process on Kyari.
The former police commander was roped in to a cyberfraud scheme that fleeced a Qatari investor of about $1 million. Kyari allegedly sustained a relationship with the kingpin of the fraudulent ring.
He was suspended as soon as the US allegation took root in Nigeria, and the Police Service Commission instituted a probe.
Kyari, many fear, may get pardoned unofficially, and he will be returned to service.
