In a significant legal decision, the Supreme Court of Nigeria has dismissed an appeal filed by Rivers State Governor, Siminalayi Fubara, challenging the leadership structure of the Rivers State House of Assembly.
The ruling, delivered on Monday in Abuja by a five-member panel led by Justice Uwani Abba-Aji, also imposed a financial penalty of two million naira against the governor in favor of the Assembly and its Speaker, Martin Amaewhule.
The case, which has been closely watched by political analysts and legal experts, was ultimately withdrawn by Fubara’s legal representative, Yusuf Ali, leading to its dismissal by the apex court.
The decision effectively upholds the authority of the current Assembly leadership, a matter that has been a focal point of political contention in the state.
Legal experts have weighed in on the judgment, highlighting its significance in reinforcing the autonomy of the legislative arm of government in state affairs.

Constitutional lawyer Dr. Adekunle Olajide noted that the ruling underscores the judiciary’s stance on internal legislative matters, suggesting that the governor’s appeal lacked substantial legal grounds to challenge the Assembly’s leadership.
“The withdrawal of the case likely indicates that the legal team foresaw an unfavorable outcome. This decision reaffirms the principle of separation of powers and the independence of the legislature,” Olajide explained.
Political analysts believe the verdict could impact the power dynamics within Rivers State, where tensions between the executive and legislative branches have been brewing. Dr. Grace Eze, a political science lecturer at the University of Port Harcourt, described the ruling as a critical moment in the state’s governance.
“This judgment could embolden the Assembly to assert greater influence over legislative decisions, potentially shifting the balance of power in state politics. It also signals to other governors the limitations of executive interference in legislative matters,” she stated.

The legal battle stemmed from a protracted leadership tussle within the Rivers State House of Assembly, with factions aligning either with Governor Fubara or Speaker Amaewhule. The rift has been fueled by broader political realignments and internal disputes within the state’s ruling party.
Observers believe the Supreme Court’s ruling might set a precedent for similar disputes across Nigeria, reinforcing the judiciary’s role in resolving inter-governmental conflicts.
Meanwhile, Governor Fubara has yet to issue an official statement regarding the outcome of the case and the imposed fine.
As Rivers State navigates the aftermath of this ruling, political stakeholders will be keenly watching the governor’s next move and the evolving legislative-executive relations in the state.
